In as much as the GenExchange ^TM   wishes to further our goal of ensuring permanent free access to genealogical data online, and in agreement with our Acceptable Use Policy (AUP) , you agree that any data you post to the GenExchange ^TM   will be "archived" for permanent free use by all visitors to the GenExchange ^TM .

The GenExchange ^TM   wishes to further our goal of ensuring permanent free access to genealogical data online. In order to further that goal, the GenExchange ^TM   offers a significant amount of resources that are freely accessible to all visitors, including free unlimited webspace through our GenExchange ^TM   Partners Program, hosted mailing lists, threaded discussion forums, Virtual Voting Booth, and search engines.

Use of GenExchange ^TM   Resources

1. The GenExchange ^TM   claims no copyright over any data you post to any mailing list, threaded discussion board, or database. You agree that by using a GenExchange ^TM   resource you grant the GenExchange ^TM   the permanent non-exclusive use of any material you post through the GenExchange ^TM   for the strict purposes of providing free information to the geneology community. Please refer to our Pledge to Privacy for additional details.
2. You agree not to use GenExchange ^TM   resources, including webspace, to post illegal, copyrighted, or trademarked material without permission of the owner. You agree to hold harmless the GenExchange ^TM , and agree to indemnify the GenExchange ^TM   in any legal action resulting as a consequence of your use of the GenExchange.
3. You agree to be held responsible for any costs, including legal, the GenExchange ^TM   incurs as a result of your use of GenExchange ^TM   resources. Partners and visitors are not responsible for costs associated with normal use of the GenExchange ^TM , or it's resources.
4. You agree to adhere to the principles of Netiquette when utilizing any GenExchange ^TM   resource. You agree not to harass, degrade, or incite any user or member of the GenExchange ^TM . The Principles of Netiquette can be located at

5. You agree your use of the GenExchange ^TM   is at your own risk, and that the GenExchange ^TM   has no liability for any damage that may occur to you as a result of your use of the GenExchange ^TM .
6. You agree not to harvest email addresses from the GenExchange ^TM   to use those addresses for commercial advertising, or harrassment.
7. You agree not to harvest data located at the GenExchange ^TM   to post anywhere else, without the prior explicit permission of the original poster.
8. You agree that this policy may be updated from time to time, and that you are required to adhere to all such updates.

GenExchange ^TM   Partners

The GenExchange ^TM   Partners Project, when available, seeks to broaden opportunties for online genealogists by utilizing GenExchange ^TM   resources. Hosting privileges are free of charge, however GenExchange ^TM   Partners Services are subject to this Acceptable Use Policy and any action contrary to this agreement are grounds for immediate, permanent loss of privileges.

1. Commercial activity by any GenExchange ^TM   Partner is specifically forbidden without express prior permission from the GenExchange ^TM . Limited commercial activity, including paid banner adds, or sale of books or genealogical materials may be allowed under certain circumstances, however no commercial arrangement or agreement may be made for sale or reproduction of any material hosted or posted to the GenExchange ^TM .
2. You agree not to upload or use any executable, including CGI scripts, to your webspace without prior permission from the GenExchange ^TM .
3. You agree not to "hack" or attempt to decompile any GenExchange ^TM   script or resource, or attempt to circumvent any security apparatus used by the GenExchange ^TM .
4. Individuals wishing to utilize GenExchange ^TM   webspace are required to prominately display the GenExchange ^TM   Partners banner or button, when it is available, on their main page, and to maintain a link from that banner or button to the main GenExchange ^TM   Partners site located at (http://partners.genexchange.org). GenExchange ^TM   Partners may be required to display paid banner advertisements, which will be subject to other terms and conditions.
5. You agree that either party may terminate website hosting services for any reason, at any time.

GenExchange ^TM   Pledge to Privacy

The GenExchange ^TM   pledges that our visitors and users privacy will be protected, and that the GenExchange ^TM   will neither sell, nor cause to be sold, any data submitted to the GenExchange ^TM , a GenExchange ^TM   hosted mailing list, or a GenExchange ^TM   hosted threaded discussion forum. Further the GenExchange ^TM   pledges that no charge will ever be instituted to access the web site, data hosted through our project, any mailing list, or threaded discussion forum, or any other resource hosted by the project. Use of any GenExchange ^TM   resource constitutes full agreement with our Acceptable Use Policy (AUP).

The GenExchange ^TM   will not, under any circumstance, sell or trade any personal information regarding our visitors, or Partners, to any unaffiliated third Party, without explicit prior permission.
